Terms and Conditions – Wickey FIT Survey

§ 1 Scope

The following terms and conditions apply to participation in the Wickey FIT survey. The following participation conditions apply uniformly and exclusively.

§ 2 Sweepstakes

(1) The sweepstakes is organized by WICKEY GmbH & Co. KG, Franz-Savels-Straße 69, 52538 Gangelt, Germany.

(2) The sweepstakes is limited in time. It begins on 12.12.2025 and ends on 21.12.2025 at 24:00. Entries submitted late will not be considered.

(3) Our prize for the winner is a refund of 100% of the purchase price.

(4) This sweepstakes cannot be combined with other sweepstakes.

§ 3 Participation

(1) Eligible participants are natural persons of legal capacity aged 18 or older. Participating customers must have their permanent residence in Belgium, Netherlands or the UK. Employees of Wickey GmbH & Co. KG and their family members are excluded from participation.

(2) Only customers of Wickey GmbH & Co. KG are eligible to participate. A prerequisite for participation is answering the 17 survey questions.

(3) The participant must complete the survey fully and correctly and send it to Wickey GmbH & Co. KG by clicking the “Submit” button (hereinafter referred to as “Registration”). Nicknames, false information, abbreviations, or pseudonyms are not permitted. The participant must provide truthful, accurate, current, and complete information about themselves (hereinafter referred to as “Registration Data”). The participant must update the Registration Data as needed and report changes immediately.

(4) Wickey GmbH & Co. KG may exclude the participant from the sweepstakes without giving reasons. This applies in particular if the participant has provided inaccurate or incomplete Registration Data. In the event of a violation of the participation conditions or justified suspicion of a violation, Wickey GmbH & Co. KG is entitled to immediately exclude the participant. In such cases, Wickey GmbH & Co. KG may revoke or reclaim prizes.

(5) Each participant may only take part in the sweepstakes once.

§ 4 Execution and Processing

(1) The winner will be determined by random draw. The draw will take place on 05.01.2026.

(2) The prize is non-transferable.

(3) The winners will be notified of their prize by Wickey GmbH & Co. KG via email on 08.01.2026.

(4) Winners must contact Wickey GmbH & Co. KG within 4 weeks after the prize notification has been sent. If winners do not respond within four weeks of the prize notification being sent, the prize expires without replacement.

(5) The place of performance is the registered office of Wickey GmbH & Co. KG in Gangelt. The payout of the prize is made via the payment method the winner provided after being notified of the prize. If payout is not possible within two months due to reasons attributable to the participant/winner, the prize expires without replacement.

§ 5 Participant Data

(1) The participant agrees that their name may be used and published by Wickey GmbH & Co. KG for marketing purposes in the event of winning.

(2) The participant expressly agrees that photographs of them may be taken on behalf of Wickey GmbH & Co. KG and used online to promote the sweepstakes. They agree that these photographs, along with the participant’s name, may be made publicly accessible for self-promotion by Wickey GmbH & Co. KG and may be passed on to the press for reporting on this or other sweepstakes. This consent also extends to publication in print and other media. The participant has no right to publication of their name or photos, nor any claim to compensation arising from such publication.

(3) The participant expressly agrees that Wickey GmbH & Co. KG may store their Registration Data for the duration of the sweepstakes and, in the event of winning, for the purpose of sending the prize and for publication under paragraph 1.

§ 6 Rights and Obligations of Wickey GmbH & Co. KG

(1) Wickey GmbH & Co. KG does not verify the Registration Data.

(2) Wickey GmbH & Co. KG is entitled to cancel the sweepstakes at any time. Reasons for cancellation do not need to be communicated. Cancellation may occur if a proper and lawful execution of the sweepstakes can no longer be ensured due to technical or legal reasons. If the cancellation is caused by a participant’s behavior, Wickey GmbH & Co. KG may claim damages.

(3) In the event of a violation of these participation conditions or justified suspicion thereof, Wickey GmbH & Co. KG is entitled to exclude the participant.

§ 7 Liability

(1) Wickey GmbH & Co. KG is liable without limitation for damages caused intentionally or by gross negligence by the company, its legal representatives, senior employees, or simple agents.

(2) In cases of slightly negligent breach of insignificant contractual obligations, Wickey GmbH & Co. KG is not liable. Otherwise, liability for slightly negligent damages is limited to foreseeable damages typical for the contract. This also applies to slightly negligent breaches by legal representatives, senior employees, or simple agents. The limitation does not apply to claims for physical injury, health damage, or loss of life attributable to Wickey GmbH & Co. KG.

(3) All information is provided without guarantee. This applies in particular to the publication of winners’ names.

§ 8 Data Protection

(1) Wickey GmbH & Co. KG treats participants’ Registration Data confidentially and only shares it with third parties to the extent permitted by data protection law, necessary for execution of the sweepstakes, prize fulfillment, or if the participant consents.

(2) Wickey GmbH & Co. KG points out that participants' personal data will be electronically processed. The data is used solely for the execution of the sweepstakes and promotion under § 5 unless otherwise agreed.

(3) With the information on the processing of personal data, Wickey GmbH & Co. KG informs participants about the type, scope, duration, and purpose of data collection, processing, and use, as well as the participant’s right to free information, correction, deletion, and blocking of this data.

§ 9 Legal Recourse

Legal recourse is excluded.

§ 10 Final Provisions

(1) The law of the Federal Republic of Germany applies. For consumers who enter the contract for purposes unrelated to professional or commercial activities, this choice of law applies only to the extent that the protection afforded by mandatory laws of the consumer's home country is not withdrawn. The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply.

(2) If the participant has no general place of jurisdiction in Germany or if their residence or usual place of stay is unknown at the time of filing an action, the exclusive place of jurisdiction is the registered office of Wickey GmbH & Co. KG.

(3) Should individual provisions of these participation conditions be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected.
